A bar complaint is not a finding of misconduct. It is, at its core, a notice that an individual, whether a client, opposing counsel, or even another professional of some type, has raised a concern with the State Bar regarding your professional conduct or practice management.
Once a complaint is submitted, the Office of Bar Counsel conducts an initial review to determine whether the allegations, if true, would constitute a violation of the Rules of Professional Conduct. Many complaints end at this preliminary screening stage without proceeding forward as a formal investigation or a disciplinary charge.
However, if Bar Counsel decides that further review is warranted, the lawyer receives formal written notice outlining the nature of the allegations and requesting a response within a designated time frame. This marks just the beginning of the investigative process. At this point the Bar’s primary role is investigatory, not punitive, nevertheless, how you engage in the process from this moment forward definitely influences the end outcome.
